H1B Visa Processing guidelines.
There are many ways to work in U.S.A legally for a professional. In all these H1B is the best available visa. This is reserved for Degree holding special workers with the Professional capacity. Specially advanced degree in science, technology, engineering, or math from any foreign university.
Most of them now goes to computer professionals while architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, law, accounting, business specialties, theology, and the arts, and requiring the attainment of a bachelor’s degree or its equivalent as a minimum.
Currently an annual cap allows H-1B admissions of 65,000 workers per fiscal year.
The H1B visa will allow the person to work for 3 years and it can be extended for another 3 years, there after the person must leave USA. If he want to apply again for the H1B visa he must stay out of USA for 1 year then he can apply for it.
Visa holder can take spouse and children under the H4 category to the U.S.
In 2007 Infosys, Wipro, Satyam, Tata, and Cognizant took much ofH-1B visas along with Microsoft, Cisco, IBM, Motorola, and Intel.

Complete a Request for Prevailing Wage Form.
Complete ETA9035 Labor Condition Application.
Print Certified Labor Condition Application.
Complete I-129 and H Supplement.
Complete I-129 W Supplement ( If necessary and applicable)
Include both filing fees:
Must Submit Filing Fee AND I-129W (ACWIA) Fee For most employers with 25 or less full-time $940.00 ($190 + $750) or most employers with over 25 full-time l$1690.00 ($190 + $1500)
Include the following documents with the I-129:
A letter to the CIS listing about the proposed employment information, which must include the
Name of the employer
Position title
Position and description
The essential duties
About the education
Training requirements
Foreign worker’s credentials ( Transcripts scripts should be attached.)
Copies of current or previous H1B Approval Notices (If had already).
Information about the employer’s business details including as copy of web site.
Copy of budget or tax return to show ability to pay.
