H-1B Visas Application Date in 2008.

US Govt will accept H1B visa application from the American Employers to issue 65,000 visas. These visas are ment for speciality occupations from people who posses bachelor’s degree or higher in the specific specialty as a minimum qualification along with expertise.

H-1B occupations normally applies to teachers, physical therapists, accountants, computer programmers and engineers. These workers are expectd to get wages and benefits equal to their US counterparts so as to not adversely affect wages and labor conditions for US workers.
H-1B workers are allowed to perform jobs for six years only, once they complete it in H-1B status, they have to leave and stay out of US for one year before appluing for another H-1B employment. ( There are some certin factors allow H1B visa holder to work in USA if passes over 6 years period.)

In 2007 when the USICS opened for accepting applications on 1st of April a record 130,000 H-1B petitions to fill 65,000-cap. 20,000 of these the first 20,000 H-1B visas issued to foreign workers with US masters degree or higher are exempt from the 65,000-cap; H-1B visas issued to such individuals subsequent to the first 20,000 are then counted against the overall 65,000-cap. While alien workers in the US with the lawful H-1B status and visa and are seeking to extend their visa or change employers, are not affected by the annual limit.

Those foreign workers who are already in USA can be granted their status to H-1B, if has lawful non immigrant status through Oct 01, 2008, the start of FY 2008/2009, so the prospective employer can file a H-1B visa petition. If the employee's non immigrant status expires prior to Oct 01, 2008 then the person must return to his home country and must face the normal process of the H-1B application.

Employers seeking to employ a foreign national on an H-1B visa for FY 2008-2009 should submit their visa petitions after valuating their need and positions through a law firm who hav expertise in this field and the employees looking for jobs should apply to the companies and corporate offices.
